What Should Be Included in a Will?
First, wills should name someone to manage the process of identifying and inventorying assets, paying off creditors, and distributing the remaining assets to each beneficiary according to your wishes. In legal terms, this individual is called an executor or a personal representative. In real terms, it's someone you trust to handle your affairs with integrity and even-handedness.
You may also want to consider an end-of-life document, which allows you to decide whether you wish to receive extraordinary care should you become incapacitated. These documents are often referred to as living wills or health care proxies.
Families with young children or family members with special needs should designate their choice for guardianship should both parents become incapacitated or die.
Colorado uses an informal probate system, which means that trusts are not the absolute necessity they can be in some other states. Wills remain the most cost-effective estate planning tool available to most individuals and families in Colorado. Wills are also the best way to ensure that your desires are followed and there is no confusion about your intentions.
Attorneys Carl Glatstein and Marci O'Brien, each have many years experience helping individuals and families draft their wills. They can answer any questions you may have and help you to identify specific items or concerns that need to be addressed in your last will and testament.
