Dedicated To Protecting Our Clients’ Interests

Glatstein & O’Brien LLP provides intelligently aggressive representation on behalf of clients who are engaged in a will contest or trust dispute.

Issues that may give rise to a trust dispute include:

  • Fraud or breach of fiduciary duty
  • Improper and untimely distribution of funds
  • Mismanagement of trust funds/making poor investments
  • Financial misconduct (excessive trustee compensation, stealing funds, etc.)

Trust Interpretation Issues

While most trust disputes involve allegations of trustee misconduct, some do not. Interpretation issues can arise because of ambiguous trust provisions and unforeseeable circumstances such as a major change in the law. In these cases, it may be necessary to have the trust reformed or amended by a judge so that it continues to reflect the wishes of the person who established it. Our firm assists clients with trust reformation and with obtaining judicial amendments to established trusts.

We endeavor to communicate with out-of-state clients in writing, by phone and fax, by e-mail, and by using overnight delivery services when necessary. We use the most cost effective means to communicate with our clients in light of any time constraints we are under. Our goal is that our out-of-state clients do not have to come to Colorado unless they wish to do so or a hearing is held at which they must appear personally. It is possible to request that a party be allowed to appear at hearings by telephone, and we do so frequently.
